CHARTERED FINANCIAL ANALYST SUED FOR AN INJUNCTION FOR DEFAMATION AND $3 MILLION

On July 27, 2018, an Order – Interim Injunction was granted by Justice Anderson in Alberta Court of Queen’s Bench Action No. 1801-08885 in favour of the Plaintiff, Brian Lovig, against the Defendant, Kurt Soost. The Order granted specifically and directly restrains and enjoins Kurt Soost from publishing any defamatory statement or defamatory material which refers in any way to Canadian businessman Brian Lovig and then specifically enunciates, for clarity to Mr. Soost, a number of statements which have been repeated by him in the past which he cannot repeat to the public in general.

For the Court to grant an injunction of this type, which restricts the speech of the Defendant, Kurt Soost, the Court was required to have found as a matter of fact and law that (i) the statements complained of were manifestly defamatory and impossible to justify, and (ii) it was beyond doubt that there were no defences available to the Defendant in response to the Statement of Claim filed in this Action on June 22, 2018.

“I am pleased that the court effectively declared that Kurt Soost is manifestly and obviously a liar. I am also happy to see that he is being held accountable for the campaign of defamation he has undertaken against me and that the basis of Mr. Soost’s attempts to extort me with his lies, for which he demanded to be paid $500,000, then $250,000 and so on or that he would ruin my reputation, has been shut down by way of the proper operation of our legal system. The most ironic part of all of this is that while Mr. Soost has repeatedly claimed that I have removed over $10 million in one case and $50 million in others through inappropriate transactions, the truth is that I have made much more than this amount in the same time period, but not in a way related to the transactions claimed by Mr. Soost.

In the end, I have spent several hundred thousand dollars to address Mr. Soost’s actions and behavior in this and other matters, but to me that’s OK as not only can I afford it, bad guys like Mr. Soost who are bullies and extortionists, need to be stopped and in my mind the cost of letting in the light to push out the darkness is always worth it” said Brian Lovig.
