
1 of Gorsuch’s 1st Cases Is HUGE for Religious Freedom… Libs Will HATE He Gets to Hear It
One of the first cases to be heard by recently confirmed Supreme Court Justice Neil Gorsuch involves a Christian preschool in Missouri that was denied state funds to improve a playground because of its religious affiliation.
After being denied the funds, Trinity Lutheran Church in Columbia, Missouri, launched a suit against the state, arguing that the denial amounted to a double standard, especially given that neighborhood children not even affiliated with the school also frequently used the playground, according to the Baptist Press.
“(W)e would just like the Supreme Court to do away with the double standard and rule in our favor (so that children) can be just as safe on our playground as they could on any other neutral playground,” Annette Kiehne, director of the church’s Child Learning Center, said during the National Religious Broadcasters’ convention last month.
Attorneys are reportedly scheduled to argue her case — Trinity Lutheran Church of Columbia, Inc. v. Comer — before the Supreme Court on April 19, and one of the justices Kiehne’s team will have to convince is Gorsuch.
According to Fox News, most analysts expect Gorsuch will ultimately rule in favor of the school. They pointed to how he had ruled in Hobby Lobby Stores v. Sebelius, a case in which the former federal appellate judge joined a majority on the 10th Circuit Court of Appeals in ruling that the family who owned the retail chain Hobby Lobby had the right to reject Obamacare’s contraceptive mandate as a matter of religious freedom.
“Gorsuch seems to be on the side believing that government programs should treat religious freedoms fairly and should recognize the rights of religious organizations to participate in public welfare-type programs,” Stephen Wermiel, a professor at American University’s Washington School of Law, told Fox News.
As noted by The Daily Signal, Gorsuch’s vote in the Trinity case “could be pivotal,” as “(t)he free exercise of religion stands as one of the most precious rights Americans enjoy” — and he now has the power to ensure this right is correctly applied.
